This website, theamericanestatekit.com (the "Site"), and the products sold on it are provided by HELP SENIOR, LLC ("we", "us", "our"), a limited liability company incorporated under the laws of the State of Delaware, United States of America, with its principal office at 1120 Logan Ave Suite #103, Cheyenne, WY 82001, USA. We publish The Estate Kit and sell digital resources to customers in the United States. Your contract is with HELP SENIOR, LLC.
Payments on the Site may be processed, and the Site's marketing and advertising spend may be managed, by Eversales Consulting LLC, a limited liability company incorporated under the laws of the State of Wyoming, United States of America (Wyoming Filing ID 2026-001870561), 1120 Logan Ave Suite #103, Cheyenne, WY 82001, USA. Eversales Consulting LLC acts in that capacity under the ownership and management of HELP SENIOR, LLC. This doesn't change who you're buying from: your order, your guarantee and your consumer rights are with HELP SENIOR, LLC, and you can always contact us directly at raphael@theestatekit.com.
These Terms of Sale apply to every order you place through the Site. By placing an order you confirm that you have read and accepted these terms. If you don't agree with them, please don't place an order.
The version of these terms that applies to your order is the one published on the Site at the time you order. We may update these terms from time to time (see section 15), but changes won't affect an order you've already placed.
What we sell is a digital product — a downloadable, fill-in-yourself organizational kit (PDF documents, printable sheets and guides) delivered electronically. It's designed to help you and your family gather, organize and keep track of the practical information and steps involved after a death in the United States, following a simple timeline.
It is an organizational aid. It is not a will, a legal document, or a government form, and it does not lodge, register or file anything with any court or agency on your behalf.
The kit is general information only. It is not legal, tax or financial advice, it is not tailored to your personal circumstances, and it is not a substitute for a will or for advice from a qualified professional such as an attorney, CPA or licensed financial advisor.
Probate, estate, tax and account rules vary from state to state, and they change over time. For decisions that matter — a will, an estate, probate, taxes or retirement accounts — you should get advice from an appropriately qualified professional licensed in your state. You remain responsible for the decisions you make.
Prices on the Site are shown in US dollars (USD). The price shown at checkout is the total price you pay for the product you selected — any sales tax that applies is included in that displayed price, and no separate charges are added at checkout. You can request a receipt for your order at any time by emailing us.
Payment is taken in full at the time you place your order, through our secure third-party payment providers (for example Stripe and PayPal). We never see or store your full card details — they are handled directly by the payment provider. Payment processing for the Site may be carried out by Eversales Consulting LLC on our behalf (see section 1); the name shown on your card or PayPal statement may reflect the entity that processed the payment. If a payment is declined, your order isn't completed and you're welcome to try again.
Your kit is delivered electronically, by email, to the address you provide at checkout. Delivery is normally within a few minutes of your payment being confirmed. If it hasn't arrived, please check your spam or junk folder first, and if it's still not there, email us and we'll send it straight over.
As a consumer in the United States, you benefit from the protections of applicable federal consumer protection law and of the consumer protection laws of the state where you live. Among other things, the product must match its description and be fit for the purpose we've described.
Nothing in these terms excludes, limits or modifies any consumer right or remedy that cannot lawfully be excluded, limited or modified under federal or state law. If there is a problem with the product, contact us and we will make it right — by fixing the problem, re-supplying the product, or refunding you.
On top of your legal rights, we offer a straightforward money-back guarantee. If the kit isn't right for you, email us within 30 days of your purchase and we'll refund what you paid. You don't need to give a detailed reason. This guarantee is in addition to — and does not limit — your rights under applicable federal and state consumer protection law.
To request a refund, email raphael@theestatekit.com from the address you used to order, or include your order details. We'll confirm your request and process approved refunds back to your original payment method, normally within a few business days.
The kit and everything in it is owned by HELP SENIOR, LLC and is protected by copyright. When you buy it, you get a personal, non-transferable license to use it for your own private, non-commercial purposes. Please don't resell, republish, share publicly or commercially distribute the materials without our written permission.
Nothing in these terms excludes, restricts or modifies any consumer right, warranty or remedy you have under applicable federal or state law that cannot lawfully be excluded. Subject to that, and to the extent permitted by law, our total liability to you in connection with the product is limited to re-supplying the product or refunding the amount you paid for it. We are not liable for indirect, incidental or consequential loss.
To process your order we collect your first name and email address, and basic order and browsing information. We use these to deliver your kit, provide support, meet our record-keeping obligations, and — where you've agreed — send you related updates. We do not sell your personal information for money. Full details, including how to opt out of sharing for cross-context behavioral advertising and the rights of California and other state residents, are set out in our Privacy Policy, available on the Site.
These terms are governed by the laws of the US state where you live in relation to your rights as a consumer, and any dispute may be dealt with by the courts of that state. This does not take away any protection that applicable federal or state consumer protection law gives you.
We may update these terms from time to time. The current version is always the one published on the Site, and the "last updated" date at the top shows when it last changed. Changes apply to new orders only, not to orders you've already placed.
