1. Who you're buying from

This website, theestatekit.com (the "Site"), and the products sold on it are provided by HELP SENIOR, LLC ("we", "us", "our"), a limited liability company organised under the laws of the State of Delaware, United States of America, with its registered office at 1120 Logan Ave Suite #103, Cheyenne, WY 82001, United States. We publish The Estate Kit, including The Kiwi Estate Kit, and sell digital resources to customers in New Zealand.

2. What these terms cover

These Terms of Sale apply to every order you place through the Site. By placing an order you confirm that you have read and accepted these terms. If you don't agree with them, please don't place an order.

The version of these terms that applies to your order is the one published on the Site at the time you order. We may update these terms from time to time (see section 15), but changes won't affect an order you've already placed.

3. What the product is

What we sell is digital content: a downloadable, fill-in-yourself organisational kit (PDF and Word documents, printable sheets, letters and guides) delivered electronically. It's designed to help you and your family gather and organise the practical information and steps involved after a death in New Zealand, following a simple timeline.

It is an organisational aid. It is not a will, an enduring power of attorney, a legal document or a government form, and it does not lodge, register or file anything with any court, agency or organisation on your behalf.

4. Not legal, tax or financial advice

The kit is general information only. It is not legal, tax or financial advice, it is not tailored to your personal circumstances, and it is not a substitute for a will or for advice from a qualified professional such as a lawyer, an accountant or a financial adviser.

For decisions that matter (a will, an enduring power of attorney, an estate, probate, a trust, tax or KiwiSaver) you should get advice from an appropriately qualified professional. You remain responsible for the decisions you make.

5. Price and GST

Prices on the Site are shown in New Zealand dollars (NZD) and are GST-inclusive: any GST that applies is already included in the price displayed. The price shown at checkout is the total price you pay for the product you selected, with no separate charges added. You can request a receipt for your order at any time by emailing us.

6. Payment

Payment is taken in full at the time you place your order, through our secure third-party payment providers (for example Stripe and PayPal). We never see or store your full card details: they are handled directly by the payment provider. If a payment is declined, your order isn't completed and you're welcome to try again.

7. Delivery

Your kit is delivered electronically, by email, to the address you provide at checkout, with a link to your personal delivery page. Delivery is normally within a few minutes of your payment being confirmed. If it hasn't arrived, please check your spam or junk folder first, and if it's still not there, email us and we'll send it straight over.

8. Your rights under the Consumer Guarantees Act

When you buy as a consumer, our products come with guarantees under the Consumer Guarantees Act 1993 that cannot be excluded. Among other things, the product must be of acceptable quality, must match its description, and must be reasonably fit for any particular purpose you made known to us.

If there is a failure of substantial character, you can reject the product and receive a refund. If the failure is not substantial, we will put it right (for example by re-supplying or correcting the product) within a reasonable time, and if we don't, you are entitled to a refund. Nothing in these terms limits or removes any right or remedy you have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.

9. Our money-back guarantee

On top of your rights under New Zealand consumer law, we offer a straightforward money-back guarantee. If the kit isn't right for you, email us within 30 days of your purchase and we'll refund what you paid. You don't need to give a detailed reason. This guarantee is in addition to, and does not limit, your guarantees under the Consumer Guarantees Act 1993.

10. How to request a refund

To request a refund, email raphael@theestatekit.com from the address you used to order, or include your order details. We'll confirm your request and process approved refunds back to your original payment method, normally within a few business days.

11. Licence and intellectual property

The kit and everything in it is owned by HELP SENIOR, LLC and is protected by copyright. When you buy it, you get a personal, non-transferable licence to use it for your own private, non-commercial purposes, including printing copies for your own family. Please don't resell, republish, share publicly or commercially distribute the materials without our written permission.

12. Our liability

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 that cannot lawfully be excluded. Subject to that, and to the extent permitted by law, our total liability to you in connection with the product is limited to re-supplying the product or refunding the amount you paid for it. We are not liable for indirect or consequential loss.

13. Your privacy

To process your order we collect your name and email address, and basic order and browsing information. We use these to deliver your kit, provide support, meet our record-keeping obligations and, where you've agreed, send you related updates. We don't sell your personal information. Full details are set out in our Privacy Policy, available on the Site.

14. Governing law

These terms are governed by the laws of New Zealand in relation to your rights as a consumer, and any dispute may be dealt with by the courts and tribunals of New Zealand, including the Disputes Tribunal. This does not take away any protection New Zealand consumer law gives you.

15. Changes to these terms

We may update these terms from time to time. The current version is always the one published on the Site, and the "last updated" date at the top shows when it last changed. Changes apply to new orders only, not to orders you've already placed.
