1. Who you're buying from

This website, theestatekit.com (the "Site"), and the products sold on it are provided by HELP SENIOR LIMITED ("we", "us", "our"), a limited company incorporated in the Hong Kong Special Administrative Region (Business Registration Certificate No. 80500630-000-05-26-7), at Rm D07, 8/F, Kai Tak Fty Building, No. 99 King Fuk Street, San Po Kong, Hong Kong. We publish The Estate Kit and sell digital resources to customers in Canada.

2. What these terms cover

These Terms of Sale apply to every order you place through the Site. By placing an order you confirm that you have read and accepted these terms. If you don't agree with them, please don't place an order.

The version of these terms that applies to your order is the one published on the Site at the time you order. We may update these terms from time to time (see section 15), but changes won't affect an order you've already placed.

3. What the product is

What we sell is a digital product — a downloadable, fill-in-yourself organisational kit (PDF documents, printable sheets and guides) delivered electronically. It's designed to help you and your family gather, organise and keep track of the practical information and steps involved after a death in Canada, following a simple timeline.

It is an organisational aid. It is not a will, a legal document, or a government form, and it does not lodge, register or file anything with any authority on your behalf.

4. Not legal, tax or financial advice

The kit is general information only. It is not legal, tax or financial advice, it is not tailored to your personal circumstances, and it is not a substitute for a will or for advice from a qualified professional such as a lawyer, notary, accountant or licensed financial advisor.

For decisions that matter — a will, an estate, probate, taxes or registered accounts — you should get advice from an appropriately qualified professional in your province or territory. You remain responsible for the decisions you make.

5. Price and sales taxes

Prices on the Site are shown in Canadian dollars (CAD). The price shown at checkout is the total price you pay for the product you selected — any applicable sales taxes (GST/HST/QST) are included in that displayed price, and no separate charges are added at checkout. You can request a receipt for your order at any time by emailing us.

6. Payment

Payment is taken in full at the time you place your order, through our secure third-party payment providers (for example Stripe and PayPal). We never see or store your full card details — they are handled directly by the payment provider. If a payment is declined, your order isn't completed and you're welcome to try again.

7. Delivery

Your kit is delivered electronically, by email, to the address you provide at checkout. Delivery is normally within a few minutes of your payment being confirmed. If it hasn't arrived, please check your spam or junk folder first, and if it's still not there, email us and we'll send it straight over.

8. Your consumer rights

As a consumer in Canada, you benefit from the protections of the applicable federal and provincial or territorial consumer protection legislation of the place where you live (for residents of Quebec, this includes the protections of Quebec's consumer protection legislation). Among other things, the product must match its description and be fit for the purpose we've described.

Nothing in these terms excludes, limits or modifies any consumer right or remedy that cannot lawfully be excluded, limited or modified. If there is a failure with the product, contact us and we will make it right — by fixing the problem, re-supplying the product, or refunding you.

9. Our money-back guarantee

On top of your legal rights, we offer a straightforward money-back guarantee. If the kit isn't right for you, email us within 30 days of your purchase and we'll refund what you paid. You don't need to give a detailed reason. This guarantee is in addition to — and does not limit — your rights under applicable consumer protection legislation.

10. How to request a refund

To request a refund, email raphael@theestatekit.com from the address you used to order, or include your order details. We'll confirm your request and process approved refunds back to your original payment method, normally within a few business days.

11. Licence and intellectual property

The kit and everything in it is owned by HELP SENIOR LIMITED and is protected by copyright. When you buy it, you get a personal, non-transferable licence to use it for your own private, non-commercial purposes. Please don't resell, republish, share publicly or commercially distribute the materials without our written permission.

12. Our liability

Nothing in these terms excludes, restricts or modifies any consumer right, warranty or remedy you have under applicable Canadian law that cannot lawfully be excluded. Subject to that, and to the extent permitted by law, our total liability to you in connection with the product is limited to re-supplying the product or refunding the amount you paid for it. We are not liable for indirect or consequential loss.

13. Your privacy

To process your order we collect your first name and email address, and basic order and browsing information. We use these to deliver your kit, provide support, meet our record-keeping obligations, and — where you've agreed — send you related updates. We don't sell your personal information. Full details are set out in our Privacy Policy, available on the Site.

14. Governing law

These terms are governed by the laws applicable in the Canadian province or territory where you live in relation to your rights as a consumer, and any dispute may be dealt with by the courts of that province or territory. This does not take away any protection that applicable consumer protection legislation gives you.

15. Changes to these terms

We may update these terms from time to time. The current version is always the one published on the Site, and the "last updated" date at the top shows when it last changed. Changes apply to new orders only, not to orders you've already placed.
